2020 Supercross Futures Contingency Program
Official Rules
THIS PROGRAM IS VOID OUTSIDE OF THE 50 UNITED STATES AND DISTRICT OF COLUMBIA OR WHERE OTHERWISE PROHIBITED BY LAW. NO PURCHASE IS NECESSARY TO REGISTER FOR THE PROGRAM.
1. Program Term and General Information. This Toyota® Moto Money 2020 Supercross Futures Contingency Program applies to select Supercross Futures AMA Amateur National Championship class racing competitions produced by Feld Motor Sports, Inc. (the "Program") and begins on October 28, 2019 and ends on December 31, 2020 (“Program Term”). This Program applies to the select Supercross Futures events described in Section 4 below (the “Supported Event(s)”).
Program Benefits (as defined in Section 5, below), are available for eligible Toyota owners or lessees (“Vehicle Owner(s)”) who are a competitor, or who have a son, daughter or legal ward who is a competitor, in one (1) or more Supported Events (“Competitor(s)”). To participate in the Program, Vehicle Owners must register their Eligible Vehicle (as defined below) and Competitors must register for Supported Events, as described in more detail herein.
This Program is sponsored by Feld Motor Sports, Inc., 800 Feld Way, Palmetto, Florida 34221 (“Sponsor”).
2. Eligibility. The Program is only open to Vehicle Owners and Competitors (individually and collectively, “Participant(s)”) who are legal residents of the 48 contiguous United States or the District of Columbia who meet the eligibility requirements in this Section 2:
- Excluded Parties. Employees of Feld Motor Sports, Inc., Toyota Motor Sales, U.S.A., Inc. ("TMS"), members of any TMS-supported or sponsored Supercross or Supercross Futures race teams, their agents, affiliates, or subsidiaries, as well as immediate family and household members (whether or not related) of same, are ineligible to participate.
- Vehicle Owners. To be eligible, a Vehicle Owner must:
- Be at least eighteen (18) years of age or older;
- Possess one (1) of the following vehicles that is a model year 2010 or newer: Toyota Tundra, Toyota Sequoia, Toyota Highlander, Toyota RAV4, Toyota Tacoma, or Toyota 4Runner (each, an “Eligible Vehicle”), and said Eligible Vehicle must be personally registered in the Vehicle Owner’s name (as an individual) either individually or jointly;
- Qualify as (or have a son, daughter, or legal ward who qualifies as) a registered Competitor; and
- Fully, properly and timely complete, submit and receive a Program Registration (as defined in Section 3, below) in accordance with these Official Rules.
- Competitors. To be eligible, a Competitor must:
- Be a Vehicle Owner and a Competitor, or be a son, daughter or legal ward of a Vehicle Owner and a Competitor;
- Possess a valid American Motorcyclist Association Number (“AMA Number”) and complete, submit and receive a registration for one (1) or more Supported Events via www.supercrosslive.com/supercross-futures or via onsite online registration at the applicable Supported Event;
* Registrations for Supported Events are limited capacity and subject to all applicable eligibility requirements, rules, terms and conditions issued by Sponsor; - Be identified in a Program Registration that has been verified and confirmed in accordance with these Official Rules; and
- If a Competitor has not reached the age of majority in his/her primary state of residence (which is 18 years of age in most states, but is 19 in Alabama and Nebraska, and is 21 in Mississippi) at the time of submission of the Program Registration (any such Competitor, a “Minor”), then the Competitor must have the written consent from his/her parent or legal guardian (when his/her parent or legal guardian submits the Program Registration) for the Minor to be a Competitor and the agreement, on behalf of the Minor Competitor, to comply with these Official Rules. Such Minor’s parent or legal guardian is responsible for completing and signing all required documents for participation in and related to the Program and Program Benefits, on behalf of such Minor.
- Contingency Payment Eligibility. If a Contingency Payment will be awarded based on an eligible Competitor’s performance in a Supported Event as described in Section 5(c), below, such Contingency Payment will be paid to the individual identified as the Vehicle Owner in the applicable Program Registration. To be eligible to receive any such Contingency Payment amount, the Vehicle Owner must:
- Have and be able to present a valid United States social security number; and
- Have a valid XTRM AnyPayTM digital wallet account.
3. How to Register. Vehicle Owners who are eligible pursuant to these Official Rules must fully and accurately complete the official Program Registration Form online at www.supercrosslive.com/toyotamotomoney (“Program Registration”). Each Vehicle Owner will be required to submit:
- Vehicle Owner’s first and last name, date of birth, legal address, e-mail address, the make, model, year and vehicle identification number (“VIN”) of his/her Eligible Vehicle, and a current, legible copy of the vehicle registration for the Eligible Vehicle (via upload according to the file format/specifications designated in Program Registration);
*Each Eligible Vehicle may be used for only one (1) Program Registration. - the e-mail address associated with the Vehicle Owner’s XTRM AnyPayTM digital wallet account for purposes of receiving any Contingency Payment awarded pursuant to Section 5(c) of these Official Rules; and
- the first and last name, date of birth and AMA Number for the Competitor that will be participating in Supported Events. If the Competitor is a son, daughter or legal ward of the Vehicle Owner, then the Vehicle Owner must certify: that the Vehicle Owner is such Competitor’s parent or legal guardian, and that such Competitor has consented to participate in the Program, has provided his/her permission for the Vehicle Owner to enter his/her information in the Program Registration, and has read, understood and agreed to comply with these Official Rules. If any such Competitor is a Minor, then the Vehicle Owner must further provide the Vehicle Owner’s written consent for the Minor to be a Competitor and the Vehicle Owner’s agreement, on behalf of the Minor, that the Minor will comply with these Official Rules.
Once a Program Registration has been verified by Sponsor as eligible under these Official Rules, the Vehicle Owner will receive a confirmation email to the Vehicle Owner e-mail address provided in the Program Registration (“Program Registration Confirmation”). The Competitor identified in the Program Registration must also separately register for each applicable Supported Event at www.supercrosslive.com/supercross-futures or via onsite online registration at the applicable Supported Event. Registrations for the 2020 Program will not apply to any future programs.
Program Registration Confirmations may take up to three (3) business days to process following Program Registration submission. If the Vehicle Owner has not received the Program Registration Confirmation within such timeframe, please check your spam folder or contact [email protected]. No Program Benefits will be available until the Program Registration Confirmation is delivered. Eligibility for any Contingency Payment (as defined in Section 5(c), below) is not available unless the Program Registration Confirmation has been delivered to the Vehicle Owner and the Competitor identified in the Program Registration has registered for the applicable Supported Event.
All Program Registrations and Supported Event registrations are the property of Sponsor and will not be returned. Sponsor is not responsible for submissions or entries, claims or notices that are lost, late, illegible, misdirected, damaged, or incomplete.
There is no fee associated with submission of the official Program Registration form or creation of an XTRM AnyPayTM digital wallet account, though standard fees shall apply for Supported Event registrations. Supported Event registration and participation is subject to all applicable terms, conditions and rules issued by Feld Motor Sports, Inc., including, without limitation, its Privacy Policy at https://corp.feldentertainment.com/en/privacy-policy/us/. XTRM AnyPayTM digital wallet account creation and use is subject to all applicable terms, conditions and rules issued by XTRM Inc., including, without limitation, its Privacy Policy at http://xtrmsupport.xtrm.com/en/support/solutions/articles/128204-privacy-policy. Participants are solely responsible for reading and complying with all applicable terms, conditions and rules. No automatically-produced Program Registrations are permitted.
4. Supported Events. The Supported Events covered by the Program consist of the twenty-six (26) Supercross Futures class racing competitions that will take place at each of the following venues (“Venue(s)”) on the following dates. For the avoidance of doubt, each individual class racing competition is a “Supported Event” and may consist of one (1) or multiple racing competitions. There is a total of Two Hundred Eight (208) Supported Events covered by the Program.

- October 2020 - 2020 SXF National Championship: by invite only; date and location to be provided by Sponsor at a later date.***All event dates and schedules are subject to change.
A Competitor must enter at least one of the Supported Events for there to be Program Benefit eligibility. All information, schedules and details pertaining to the Supported Events are subject to change at any time. Please refer to www.supercrosslive.com/supercross-futures for the most up-to-date event information.
5. Program Benefits. The Program benefits available to eligible Participants in accordance with these Official Rules are as follows (the “Program Benefits”):
- Early Entry Bonus: One (1) Free Monster Energy Supercross Ticket.
*First Fifty (50) Early Supported Event Registrations for each Venue*
For each Venue, for the first fifty (50) Competitors that are identified in a verified and confirmed Program Registration and registered for a Supported Event at the Venue (registration must occur following Program Registration Confirmation) at least seventeen (17) calendar days before the Supported Event, a redemption code will be sent to the Vehicle Owner e-mail address that was provided in the Program Registration. The redemption code will be valid for one (1) complimentary ticket to attend the Monster Energy AMA Supercross, an FIM World Championship event that takes place at the Venue on the same event weekend as the Supported Event. If the Supercross event includes a pit party, the redemption code will also be valid for one (1) complimentary pit pass. Codes must be redeemed by phone no later than ten calendar days prior to the Supported Event to claim the complimentary ticket (and, if applicable, pit pass) – please call 866-248-8740 and select option “2”, Monday – Friday between 9AM and 6PM Eastern Time. Additional tickets and pit passes may be purchased at the time of redemption, if available, at market pricing. This Program Benefit expires ten calendar days prior to the Supported Event date or once fifty (50) redemption codes have been issued, whichever is earlier. - One (1) Supported Event Fee Waiver.
For each verified and confirmed Program Registration, the Competitor identified in the Program Registration will be entitled to one (1) Supported Event online entry fee waiver. Following the delivery of the Program Registration Confirmation, the waiver will be automatically applied to the next Supported Event that the applicable Competitor registers for with the AMA Number that was included in the Program Registration. Upon entry of the applicable AMA Number in the online Supported Event registration form, the waiver will be applied and the registration fee at checkout for the Supported Event will be $0.00. This Program Benefit is only valid for the first online Supported Event registration processed following the delivery of the Program Registration Confirmation and is limited to one (1) per AMA Number. This Program Benefit cannot be applied to prior event registrations and will not be issued in the form of a payment or refund. - Opportunity to Compete for Supported Event Contingency Payments. If a Program Registration Confirmation has been delivered to the Vehicle Owner and the eligible Competitor identified in the Program Registration has registered for one (1) or more Supported Events, then the Vehicle Owner will be eligible to receive Contingency Payments based on the Competitor’s performance in such Supported Events, as described below:
- For each Supported Event, subject to the requirements in this Section, if the eligible Competitor finishes the applicable Supported Event and places in the top 22 finishers for such Supported Event (out of all Supported Event participating competitors, regardless of whether competitors are participating in the Program), a payment will be awarded to the Vehicle Owner based on the place that the Competitor finishes and the following payment schedule (each, individually, a “Contingency Payment”):

Any such modifications will be communicated via updated Official Rules posted on www.supercrosslive.com/toyotamotomoney and will be effective for the Supported Events thereafter.
- Only one (1) Contingency Payment amount per listed place finish is available for each Supported Event. If more than one (1) eligible Competitor ties for any finishing place in a Supported Event, then the available Contingency Payment amount will be divided equally based on the number of such Competitors tying for such finishing place.
- There are no minimum participating competitors required for Contingency Payment(s) to be awarded for eligible Competitors. However, if a finisher in the applicable finishing position is not an eligible Competitor, or if there is no finisher for the applicable finishing position, a Contingency Payment will not be awarded for that finishing position. If no eligible Competitor finishes in the top 22 finishing positions, no Contingency Payment amounts will be awarded under this Program for that Supported Event. Any eligible Competitor that is a DNS (did not start), does not finish or is otherwise disqualified will not be eligible for any Contingency Payment amount.
- Contingency Payments will be awarded for a maximum of two (2) Supported Events per Venue. If the eligible Competitor races and finishes in the top 22 for more than two (2) Supported Events at a Venue, a Contingency Payment will only be awarded for the top two (2) finishing positions.
- Each Competitor that finishes in the top 22 finishing positions for a Supported Event and the Vehicle Owner that is the potential Contingency Payment recipient are subject to verification of eligibility and compliance with these Official Rules. Where required by Sponsor, the potential Contingency Payment award recipient must complete and return to Sponsor (or its designee) an award claim form and/or W-9 by Sponsor’s designated deadline. Failure to complete any such required documentation by the required deadline will result in forfeiture of the Contingency Payment and no further compensation shall be due to that potential Contingency Payment recipient.
- All Contingency Payments will be paid to the applicable Vehicle Owner via XTRM AnyPayTM digital wallet to the account designated in the Program Registration once results are entered and validated by the Sponsor and submitted to XTRM, Inc. for processing. Participants have 45 days from the date of the Supported Event to inquire about errors or missing payments; otherwise, those Contingency Payments will be forfeited. Inquiries received more than 45 days after the Supported Event will not be processed. In no event will any Contingency Payments be made for the 2019 Program after July 31, 2019.
- For each Supported Event, subject to the requirements in this Section, if the eligible Competitor finishes the applicable Supported Event and places in the top 22 finishers for such Supported Event (out of all Supported Event participating competitors, regardless of whether competitors are participating in the Program), a payment will be awarded to the Vehicle Owner based on the place that the Competitor finishes and the following payment schedule (each, individually, a “Contingency Payment”):
6. General. This Program shall be staged in compliance with, and is subject to, all federal, state and local laws. Failure of any Participant to comply with any Program terms for any reason, or, the return of any Program-related notification or Program Benefit as undeliverable, or, the determination that a Participant is ineligible to receive a Program Benefit, will result in forfeiture of any and all applicable Program Benefits. Program Benefits are not transferable. Program Benefits must be accepted as awarded and no substitutions are allowed. Unclaimed Program Benefits will be forfeited and will not be awarded. Program Benefit recipients are responsible for all federal, state and local taxes. For any Program Benefit(s) valued at $600 or more, the Program Benefit recipient agrees to provide his/her social security number, and Sponsor will provide a federal form 1099. Except where prohibited, participation in the Program constitutes Participant’s (or if Participant is a Minor, his or her parent’s or legal guardian’s) consent that Participant’s name, hometown, photograph, likeness, voice and/or biographical data may be used by Sponsor and/or TMS for advertising, promotional and other commercial purposes without limitation and without additional notice, compensation or consent, each in accordance with Sponsor’s and TMS’s respective privacy policies, as applicable, available at https://corp.feldentertainment.com/en/privacy-policy/us/ and https://www.toyota.com/support/privacy-rights. Odds of receiving any Contingency Payment depend on Supported Event Competitors’ performance.
Sponsor has the right to cancel or modify this Program at any time, without prior notice. Sponsor shall have sole and final discretion in determining, interpreting and applying these Official Rules and all applicable race rules, terms and conditions and in selecting and determining final race standings for all Supported Events. By participating in the Program, each Participant accepts and agrees to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects, and waives any right to claim ambiguity with regard to the mechanics of the Program or the interpretation of the Official Rules. Sponsor reserves the right in its sole discretion to disqualify any Participants (and the corresponding Program Registrations) that Sponsor finds to be falsifying information, tampering with any registration process or the operation of the Program or to be acting in violation of these Official Rules or any applicable Supported Event rules, terms or conditions or otherwise in an unsportsmanlike or disruptive manner. Sponsor reserves the right to disqualify or reject any incomplete, inaccurate or false Program Registration or Supported Event registration.
By accepting a Program Benefit, the Program Benefit recipient agrees to indemnify, hold harmless and release Sponsor, TMS, XTRM, Inc., their respective affiliates and related companies, and all of their respective directors, employees, officers, and agents, including without limitation their advertising and promotion agencies (collectively, the "Released Entities"), from any and all liability, property loss, damage, personal injury or death arising out of or in connection with the awarding, receipt, use or misuse of the Program Benefit or participation in any related activities. The Released Entities shall not have any responsibility or liability whatsoever for any property loss, damage, personal injury, or death, in connection with any person's participation in the Program or any Supported Events. By participating in the Program, Participants agree to indemnify, hold harmless and release the Released Entities from any and all liability, property loss, damage, personal injury or death arising out of or in connection with their participation in the Program and/or any Supported Events.
None of the Released Entities are responsible for any Program Registration, event registration or other information that is lost, late, misdirected or undeliverable, whether due to system errors, omissions, interruption, deletions, defects, delay in operations or transmissions, theft or destruction or failures, faulty transmissions or other telecommunications malfunctions, information not received resulting from any hardware or software failures of any kind, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors and failures, technical malfunctions, or otherwise. Should any portion of the Program be, in Sponsor’s sole discretion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole discretion of the Sponsor, corrupt or impair the administration, security, fairness or proper operation, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Program and conduct the Program in a manner which in its sole discretion is fair, appropriate and consistent with these Official Rules.
7. Disputes. Participants agree that: (a) any and all disputes, claims, and causes of action arising out of, or connected with, this Program (including, without limitation, any alleged violation of these Official Rules, any controversy relating to the arbitrability of any dispute, or any claim that these Official Rules (or any part thereof) are invalid, illegal, or otherwise voidable (or void)) shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to be held solely in New York, New York under the auspices of the American Arbitration Association; (b) any and all claims, judgments, liabilities, and/or awards shall be limited to actual out-of-pocket costs incurred, including costs associated with Participant’s participation in this Program, and in no event will Participant be entitled to receive attorneys’ fees or other legal costs; and (c) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives, all rights to claim, punitive, special, incidental, and/or consequential damages and any other damages, other than out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof. This arbitration provision shall be deemed to be self-executing, and in the event that either party fails to appear at any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear. In no event shall Participant seek or be entitled to rescission, injunctive, or other equitable relief or to enjoin or restrain the operation of this Program, exploitation of any advertising or other materials issued in connection therewith, or exploitation of this Program or any content or other material used or displayed on this Program. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and Sponsor in connection with the Program, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS PROGRAM WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
